1. Who is responsible for your data

Axomatic is a software development studio based in Guadalajara, Jalisco, Mexico, responsible for processing the personal data we receive through this site (axomatic.com.mx), its contact form, the chatbot, and the associated commercial channels.

Under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its applicable rules, we can provide additional formal identification details of the controller on request, through the contact email indicated. This document is general information you should read and, when needed, validate with your own advisor before fully relying on it.

2. Scope and acceptance of this notice

This privacy notice applies to the Axomatic landing and its services, projects, about, and legal pages published under axomatic.com.mx, as well as to the conversations you start through the form, chatbot, email, or WhatsApp.

Our principle is to use as little data as possible and with a clear context: respond to prospects, operate the site experience, and follow up on commercial conversations you start. By sharing information with us through any of these channels, you accept the processing described in this notice.

3. Personal data we may receive

The data we receive depends on the channel you use and on what you decide to share with us; you are not required to give us more information than is necessary to handle your request.

  • Identification and contact data: the name or company and email you type in the form.
  • Content of your request: the project or need you describe in the message.
  • Messages written in the Axy chatbot together with the selected language used to answer in context.
  • Basic technical data sent by your browser or our infrastructure (such as approximate IP address, browser identifier, and timestamp) to serve the site, remember the language, and prevent abuse.
  • We do not request sensitive personal data; please do not include financial, health, or other sensitive information in form or chat messages.

4. Contact form and email delivery (SMTP)

When you submit the contact form, your data is transmitted to our server and sent by email through an SMTP service. We generate two emails: an internal notification to the Axomatic team inboxes and an automatic confirmation to the email you provided.

So we can reply to you, the email you provide is used as the reply-to address of the internal notification. Along with your message, our server records technical metadata about the submission for security and abuse-prevention purposes, not for profiling.

  • Internal notification: we send your name, email, and message to internal team inboxes for commercial follow-up.
  • Automatic confirmation: we send you an acknowledgment email confirming we received your message.
  • Your email is set as the reply-to address so we can respond to you directly.
  • We record submission metadata such as IP address, browser identifier, and date/time to apply per-user limits and anti-spam filters.
  • We use a hidden field (honeypot) and a fill-time check to distinguish automated submissions; these controls do not collect additional data about you.

5. Purposes of processing

We process your data for primary purposes, necessary to handle your request, and for secondary purposes you can limit without affecting how we handle your requirement.

Primary purposes are essential to the relationship; secondary purposes are optional and you may object to them at any time.

  • Primary: reply to requests, quotes, and provide initial follow-up on your project.
  • Primary: send the automatic confirmation and coordinate a later human conversation.
  • Primary: operate the chatbot and detect out-of-scope or abusive requests.
  • Primary: apply anti-spam filters, rate limits, and basic security controls.
  • Secondary: improve the clarity of our messages and the structure of the site based on received requests.
  • Secondary: contact you with commercial information about services related to your inquiry.

6. Consent, providers, and transfers

By sending us information through the form, chatbot, email, or WhatsApp, you grant your consent to the processing described. For secondary purposes, your consent is deemed granted if you do not state your objection through the means indicated in this notice.

To operate the site we work with providers and external channels that process part of the information as processors or third parties, under their own policies. Some may store or process data outside Mexico; by using the site you acknowledge that the remittances or transfers necessary to provide the service may occur.

  • SMTP services to send the internal notifications and automatic confirmations.
  • OpenRouter to generate chatbot replies when that function is enabled.
  • Hosting and infrastructure providers that serve the site and receive technical logs for each request.
  • External channels such as WhatsApp or portfolio websites, which operate under policies outside Axomatic.
  • We do not sell your personal data nor share it for third-party advertising.

7. Cookies and similar technologies

We use a minimum of local-storage technologies and strictly necessary cookies for the site to work, such as remembering the selected language and keeping the browsing experience.

We do not use advertising cookies or sell browsing profiles. You can block or clear the site's storage from your browser, bearing in mind that some features, like remembering the language, may stop working as expected.

  • Data your browser sends in a standard way to load the site.
  • We do not use advertising trackers or third-party cookies for marketing.

8. Retention and security

We keep data only for as long as reasonably necessary to handle the conversation, continue a commercial process, resolve incidents, or meet applicable operational and legal obligations.

We apply reasonable administrative and technical security measures; however, no internet-connected system can guarantee absolute security.

  • We delete or archive conversations when they stop being useful for commercial follow-up.
  • We do not publish form or chat data as portfolio or marketing content without prior agreement.
  • Private credentials and sensitive sends are handled on the server side, with secrets separated from the client.
  • We use form validation, honeypots, IP-based limits, and restricted access to operational accounts.

9. Your ARCO rights and control over your data

Under the LFPDPPP, you have the right to access your personal data, rectify it when inaccurate, cancel it when you believe it is not needed for the stated purposes, and object to its processing (ARCO rights). You may also withdraw your consent and limit the use or disclosure of your data.

To exercise any of these rights, write to us at axomaticdev@gmail.com stating your request and a way to contact you; we will respond within a reasonable time. If you believe your data-protection right was violated, you may turn to Mexico's National Institute for Transparency, Access to Information and Personal Data Protection (INAI).

  • Access: confirm what data we hold and how we use it.
  • Rectification: correct inaccurate or outdated data.
  • Cancellation: request the reasonable deletion of your data.
  • Objection: object to the processing or to secondary purposes.
  • Withdrawal: revoke your consent, or use email or WhatsApp as an alternative channel to the chatbot.

10. Minors and international users

The site is aimed at companies, professionals, and individuals seeking software development services; it is not directed at minors, and we do not intentionally collect data from minors.

If you contact us from outside Mexico, you acknowledge that your data will be processed in Mexico and by the providers indicated. For users subject to frameworks such as the EU GDPR or other equivalent laws, we will reasonably handle analogous requests for access, rectification, erasure, and objection in line with this notice.

  • We do not request or seek data from minors.
  • The main processing takes place in Mexico and through the providers described.
  • We handle equivalent requests from international users to the extent reasonable.
